I have been fighting for the right to be the true owner of an automobile (pickup) since July 4, 1998. I had discovered through the Bankers Book of 1985, the Alaska Statutes in title AS 45. (Commerce), Blackstones Commentaries, and the connection of registering a vehicle and true ownership. [I will in the future provide the documents on this issue, with a more detailed explanation of ownership.]
I subsequently surrendered my certificate of Motor Vehicle of the State of Alaska, tags and registration to the Department of Motor Vehicles (DMV) on by blue pickup. I then filed a UCC 1 with the State of Alaska to give them notice that I had a perfected security interest in my blue pickup. I have since July 4, 1998 had many tickets on lack of registration on my pickup, which have no points, just a fine of which I have never paid any of them.
The ante was raised when a Alaska State Trooper Cyr stopped me (with 4 other troopers in tow), took me to jail on an Anchorage ticket that I forgot about that had a warrant issued (illegally) and took my drivers license and kept it. He later refused to return it after several telephone calls. I had UCC 1-207 in very small print above my signature. One day two months later at the Alaska Court House in Palmer, he attempted to give it back. I refused and told him that I hereby surrendered the drivers license to him as obviously there was something I didnt understand about said license and there must be some obligations that was very dangerous not revealed to me by having a drivers license. I had two witnesses when I did this.
I subsequently had a couple of traffic tickets that I experimented with by not responding to see what they would do with them. They sent them to the Attorney General of the State of Alaska for collection. Evidently there was enough points to suspend my drivers license. But of course you can't suspend what has been surrendered, but that isnt the way the State of Alaska looks at this situation. That issue can be beaten also.
Then I started getting no drivers license tickets in Anchorage. I got the first three driving while my license was purportedly revoked and I tried several commercial remedies by returning the tickets to the Mayor as there is no "District Court of Anchorage". They would return them and I would return them. I would return them and they would return them. Different processes of Notice of Dishonor and returning them evolved into the Municipality of Anchorage never prosecuting the first three tickets. I still dont understand why they didnt prosecute them.
During this process I received two more driving while my license was supposedly revoked. All of a sudden the municipality decided to proceed with prosecuting these two on a very fast track. I did subpoenas but the judge quashed almost all of them. Judge Ashman came right out in open court and stated that it looked like I wasnt going to have any defense. They were very determined to get me convicted as I had attempted to arrest the judges, police and others by a citizens arrest in open court for impersonating public officers many times. I have had judges and prosecutors leave the courtroom with the court on the record with only the clerk, myself, two troopers and 15 witnesses.
We went through the process selecting a jury (6 man illegal) and then the prosecutor came forward and said if I would get a drivers license, pay $400 and do 80 hours of community service, the municipality would be satisfied. I would not have to plead guilty, just an arrangement. With the current situation, I considered his offer and decided to proceed this way as means of regrouping for the next battle. This fast track trick that they pull is a very interesting trap.
I proceeded to get the drivers license as this was never my initial goal, but this issue will be revisited and won. I printed on the signature line "WINTERROWD, RALPH K UCC 1-207". The lady said I had to do a script signature and I informed her this was it. If she wanted to sign in my place, please help yourself. She relented and let it pass.
I waited four months for the order of the judge in writing with a signature on the fine and community service, which never came. In the mean time the DMV threatened to cancel the drivers license because of an "illegal signature". I did a FOIA with one of the questions being, what is an illegal signature? They responded with BS answers and again threatened to cancel my drivers license on January 9, 2000. I let it pass to see if they would. I heard nothing from them.
Then on February 14, 2000, the municipality of Anchorage had a hearing without notifying me. Another one of their great tricks. Then of course I didnt show and they proceeded to issue two more warrants of arrest. Six weeks later at the local expresso, I was arrested and another $1,000 of bail money was required for the two drivers license tickets.
I went into another arraignment and they refused to even let me talk. I tried and the judge just proceeded and went to the next case. Since I did a couple of Notice of Dishonor's and protest to their commercial presentments in open court, they have refused to let met talk.
At this point, trial call was set for May 22, 2000. On May 9, 2000 I issued my first discovery documents [4936CR - 5441CR] You will notice in the discovery documents that I use no court titles as the court is unlawful, no plantiff or defendant status, no recognition of the Municipality of in the venue or jurisdiction of a heading, and only a case number! They have never refused to file the documents in this form in the State courts.
The Municipality of Anchorage didnt respond, so I issued another request on May 15, 2000 with a "demand" for a continuance [4936CR - 5441CR]. On Friday, May 19, 2000 I received in the mail that the Municipality had dismissed both charges and the failure to appear. [4936CR - 5441CR dismissals].
I called the prosecuting attorney on May 23, 2000 to ask for the status of my bail money. He curtedly stated that this was a court system issue and hungup on me. I was going to ask him why the Municipality has changed its mind all of sudden on the prosecution, but no chance. I presume that means I won't get invited to any of the prosecutors Christmas or birthday parties. O'well, the price we have to pay for the truth! Ha!
So now the score stands at Ralph "5" and the Municipality "0" on driving with a drivers license purportedly "revoked" and/or "canceled." I have one more of those tickets pending in the Mat-Su Valley, but the discovery will kill that one also.
There have been several people in Alaska over the years fighting the issue of no drivers license and to my knowledge, I have never seen any of them force the issue to be dismissed. The Notice of no Official Bond on 47 judges, justices and clerks; and the Articles of Impeachment on the 29 judges and justices that I filed in Juneau on April 27th, 2000 may be part of the win, but I think the real story is combining the commercial information we have discovered, the information on the court system that doesnt exist, the unlawful judges, unlawful police, unlawful prosecutors and using the"legal process." One of the important tricks is getting "real evidence" into the court system properly. More on that at a later time.
