Alaska Attorney General's Responses

Response to Question 1

Subject: Re: Criminal Rule 16(a) unconstitutional

Dear Mr. Winterrowd:

Thank you for contacting the Office of the Attorney General regarding
what you believe to be in infringement of your constitutional rights.
The United States Constitution protects only those rights considered
"fundamental," as interpreted by the United States Supreme Court.  The
Constitution does not explicitly protect driving on public roadways as a
fundamental right, and no decision has interpreted the Constitution to
include such a right.

If you believe that your rights were violated, you may want to contact
an attorney.   If you need assistance locating an attorney, you may
contact the Alaska Bar Association's lawyer referral line at (800)
770-9999 or direct is (907) 272-7469.  Their mailing address is 510 L
St., Suite 602, Anchorage, AK 99501.  If you cannot afford an attorney,
you may try Alaska Legal Services at 276-6282.  They offer free legal
services to those that qualify.
